Cooperatives as a legal entity. Background, current situation and constitutional perspectives in Cuba

Abstract

The paper of Law in the origin and the development of the cooperativism and the current tendencies of the co-operative as a juridical figure are valued in the article, in order to analyze the risks that the revolutionary essence of the movement faces. According to that the article analyzes the antecedents and the current juridical regulation of the co-operative in the Cuban Socialist Constitutional, in which the literal recognition of this figure is limited to the agricultural sector of the economy; in spite of it, the article concludes arguing the historical and constitutional pertinence of their instrumentation in other sectors of the national economy.
