Abstract

Presenting the differences in trials occurring in a range of 10 years of the Superior Court and the Supreme Court on the same issues apply to cooperative societies, the article refers to the concept of empathy proposed by Max Scheler. Even recognizing that cooperatives are a sustainable way to happiness, informative attitude present in the usual arguments in this regard is limited to a phenomenological response to the implicit problem of identity in the trials that took place in the courts. Moreover, without the primacy of synchronic consideration, any diachronic analysis is no guarantee for its accuracy. This is a diacritical sense of madeleines of Marcel Proust in relation to legal and economic literatures that address prevalent cooperatives.
