Cooperative principles, their relativity, and their controversial value as legal sources
Abstract
The paper deals with the origin and evolution of the seven cooperative principles of the International Cooperative Alliance and their value or not as a source of national law, returning to the classic discussion of the legal value they really have. To check if these principles bind legislators, if they serve as simple guides or if they have remained a mere decalogue of good intentions without great legal value, an investigation is carried out into the specific normative reflection that each of them has had in the Law. positive. Regarding Spanish Law, it is analyzed how historical and current cooperative legislation has received the different cooperative principles and how their recognition varies greatly between some autonomous laws and others. The different legal treatment that cooperative principles have had in different systems of comparative law is also analyzed, which results in a great lack of homogeneity in their regulations that demonstrates the temporal and spatial relativity of these principles.
