Abstract

This article is divided into two parts: the first presents and discusses the most recent trends of cooperative law in the global context; the second examines, also from a comparative legal perspective, the more specific issue of the supervision of cooperatives. The common thread is the cooperative identity. The article puts forward that cooperative supervision constitutes an essential element of cooperative legislation to the extent that it protects in an appropriate manner the specific identity of cooperatives, which the very cooperative legislation should establish in order to prevent cooperatives from being assimilated to other companies, notably, for-profit stock companies.
