The regime of the application of results in portuguese credit cooperatives. A critical analysis

Abstract

The Mutual agricultural credit banks, taking into account their cooperative nature do not have a profitable scope but a mutualistic scope, consisting in promoting the economic needs of its members. Thus, we argue for the impossibility of a distribution regime of the results provided for in legislation regulating these entities, since this allows a return of the surplus in the form of remuneration of the contributions to share capital, converting it into a dividend distribution. We argue that the remuneration of the contributions to the share capital in the cooperative does not constitute a distribution of results but a cost. In turn, the cooperative surpluses are not profits and the patronage refund does not constitute a dividend.
